“The panel of experts, comprising Audley Sheppard QC (Clifford Chance LLP), Peter Maydon (HM Treasury) and Hugh Mercer QC (Essex Court), discussed international arbitration in the context of economic sanctions. Irvinder Bakshi (Chairman, London Branch) chaired the session. Peter Maydon, Deputy Head of the Office of Financial Sanctions Implementation (“OFSI”), addressed the work of the newly established OFSI, highlighting the effect of financial sanctions and the importance of compliance, providing practical tips on how best to engage with the OFSI on sanctions matters and licensing issues. Drawing on his experience as Vice President of the LCIA Court and Co-Head of the International Arbitration Group at Clifford Chance LLP, Audley Sheppard QC provided an invaluable insight into how the LCIA deals with sanctions issues, with particular consideration of the impact of sanctions in the arbitration arena. Hugh Mercer QC concluded the session by providing counsel’s perspective on the impact of economic sanctions on the preparation and presentation of a case, with consideration of a practical example and relevant regulations and case law. A lively question and answer session followed the speakers’ presentations, after which Irvinder Bakshi thanked the speakers, host and organisers, in particular Jacomijn van Haersolte-van Hof (Director General, LCIA).
